This is messy, because the article goes on to say
"However, developers and publishers who choose not to support Smart Delivery can still offer owners of current-gen games a discount on purchasing a second next-gen version of the game on the Microsoft Store. Theoretically, third-party publishers could also charge for physical game upgrades via their own schemes, such as via retailer promotions."
So MS can't force thier hand, they can sell thier content however they like, but not in certain ways? Honestly I think this is good, it will force companies that want to charge consumers twice into the spotlight appearing greedy to the public and media...but ONLYIF enough 3rd party devs adopt smart delivery or free upgrades
