I don't even see it as being a direct reference to begin with. It was there to explain why the Avengers aren't in New York during the game.

The upcoming Spider-Man they're adding to the Avengers game isn't even the same Spider-Man anyway. The games aren't in the same universe.

It's vague enough that they could easily say one way or the other, but regardless their Spider-Man isn't even going to be in the Avengers game so it's completely irrelevant.
