Not a lawyer but it is a civil matter? So it's only enforceable by law if they do take it to court and win.

No way to tell if its real or not. People make silly demands and arguments all the time. Could be a hoax, and could easily be someone's unusual demand when they feel their time is wasted. But the chances a court would award the company money from the applicant seem non-existent in the US at least, unless some random state has a really weird law. If anything, I would expect the employer to get banged for filing a frivolous lawsuit if they brought it to court in the US.

Looks like a scam, interview lots of people for a job that does not exist then send out these letters and see who pays.
