Apple's lawyer called out the fact that Itch.io hosts porn games, which could laid an easy path to porn accessible to children on EGS

It's less about there being "sexualized games" on itch.io and more about being able to access them via the EGS store. Currently on PC, but if they win this case then having this on Phones as well. Content that they don't control or moderate.

Looking a bit at the transcription, even the judge interjects into the questioning.

https://www.theverge.com/2021/5/7/2...-offensive-sexualized-unspeakable-games-day-5

Attorney: And Itch.io is now available as an app on the Epic Games Store, correct?

Allison: Yes.

Attorney: And those apps on Itch.io have not gone through any review process whatsoever. Correct?

Allison: They are subject to whatever process Itch.io puts in front of their devices.

Attorney: Right. So Epic Games, you’re sure, is on the hook for whatever process Itch.io puts in place to review these games that are so offensive we cannot speak about them here, correct?

Allison: I disagree with that statement.

Judge Rogers: So can you or can you not access those apps through your app store?

Allison: You cannot access those apps through the Epic Games Store, no. You can access those apps through their application, which that is what we are downloading: Itch.io, which is an app store. [Users] have their own account with them, and you use their store and are subject to their end user agreement.

Judge Rogers: So if I have a phone and your app store was on that phone, that other store could be downloaded which has all of this offensive material.

Allison: Not on your phone. The app could be downloaded onto your PC and you could access their app on your PC.

Judge Rogers: But that’s what you want to do on a phone too. That’s what I understand.

Allison: I don’t know that we would want to do that with Itch.io [on a phone].

Judge Rogers: But you’re doing it now, so I could access it on my PC, right?

Allison: Yes.

Judge Rogers: And this lawsuit’s about your ability to do it on your phone, right?

Allison: Yes.

For some reason I thought you were referring to the PS1 game Alundra!

The Judge is not stupid. Apple lawyer is just picking apart Epic from limb to limb. Epic thought they had an ace up their sleeve by allowing itch.io on their store, but now its more of a liability to their lawsuit.

When will someone tell the judge that it is not the role of corporations to police what users do with their devices?

The arguments brought up in this lawsuits are beyond retarded. Who gives a shit about porn? I start to think Epic should've sued in a EU country, not in a US court.

Even easier to just whip out your iPhone open Safari. Don't even need to be near the PC! Much more convenient.
but sticky fingers on the scree……
I find it always hilarious anything sexual is forbidden but taking a gun and start mass murders is totally ok.
Thats the American way! Where violent movies are ok, but movies depicting anything vaguely resembling sexuality is censored.

I am glad I live in Europe, the land of painting and sculptures that depicts breasts, buns and genitalia!

art rules!

Is Apple aware of the irony that people can and likely to search for Porn on Safari. What are they gonna remove that from their iPhones?

Fucking idiots
yeah, you can just search for porn through safari but then that's not really apple's fault just like it wouldn't really be epic's fault if someone went to itch outside their store. the difference is Epic is listing and advertising it through their store. Apple doesn't list any apps/games that have porn. ever think maybe you're the idiot?

And how is that functionally different from downloading any other browser listed and advertised on the app store and then search The Unspeakable Things with it?
Not that you couldn't already do it with Safari, regardless. But if the matter is about downloading something from a store that, once used, can show you porn if you search for it...there is no difference at all.

Yeah there were so many games like that lol
I remember a ”game” where you simply saw a woman filling the whole screen with legs apart, joystick moved her hand, 1:1 motion, had to keep going carefully for awhile, build it up, and the goal was an orgasm 🤣

The pretending to care for children card strikes again, you can replace itch with pornhub and EGS with Chrome and it would still make perfect sense in a case of blocking other browsers to be installed on iOS :messenger_tears_of_joy:

Steam adult games are tagged and age-gated, that's the stipulation for them being on the platform. If you don't have a Steam account, just browsing through the store won't let you see any adult content. Even if you do have an account, you have to specifically enable the adult content categories to see them come up in search, let alone on the frontpage.

I don't remember how Itch.io has it set up, but I sort of doubt it's nearly as thorough.
Let's not pretend Steam have done a good job in this regard, it only takes a couple clicks to let you configure if mature content shows up, not much different from those are you 18 checkboxes.

Have you been on the internet?
Porn ads are literally everywhere. Go on reddit and you can quite casually come across something NSFW. Heck you can download free versions of a lot of applications (which kids are likely to as they have no money of their own) and those can show a fuckload of porn ads/"find hot singles here" ads.

And what makes you think that Epic is advertising Itch/Porn games on its front page such that children will just be running into it casually. The likelihood is that you'd have to actively search for games on Itch within Epic's store to find any Porn games.
Lets be real now, Epic's store is primarily a vehicle to access Fortnite, so that shit will be front and centre everywhere and kids aren't likely to look past that.

And no. I don't think I'm an idiot. Apple are virtue signalling here, because they don't have a real point or case. They don't give a single fuck about Children. If they cared about children instead of just blocking porn games, they'd block games/apps with microtransactions, which is such an easy and obvious way to get kids hooked into gambling. Ah but no, they don't care about kids potentially getting addicted to spending mommy and daddy's cash on loot boxes to roll their favourite legendary Fortnite skins. And ultimately that can be just as damaging to a child's behavioural development as seeing some porn games (that they probably can't even immediately download due to age restrictions).

This is Apple protecting their interests and putting out a ham-fisted excuse to try and continue getting their way and further tightly restricting their platform so they can maximise their revenues from software developed by others.
