Innocent man spends 18 months in prison after Skyrim username mixup

An innocent man spent 18 months behind bars after police missed an underscore in a Skyrim-inspired username and identified the wrong person.

Brandon Klayme, from Halifax, Canada, was convicted following an investigation that began in Wisconsin in 2018. The case centered on a Kik account whose username referenced the iconic "Fus Ro Dah" Dragon Shout from The Elder Scrolls V: Skyrim.

However, investigators made a one-character mistake when requesting the account's information from Kik, setting off a chain of events that took years to unravel.

Police confused two Skyrim-inspired usernames

The account police intended to investigate was named "fus__ro_dah," with two underscores after "fus." The subpoena sent to Kik instead listed "fus_ro_dah," which had only one underscore and belonged to Klayme.

Kik supplied investigators with information connected to Klayme's account, including his email address. Police then traced him to Nova Scotia, where officers searched his home and seized several phones and laptops in February 2020.

According to Ars Technica, investigators found no evidence connecting Klayme to the underage victim or the conversations at the center of the case. They also could not establish that he had used Kik during the period being investigated.

Despite this, the Skyrim fan was arrested and later convicted on three charges tied to the child-luring case, including providing sexual material to a child and possession of CP. He received an 18-month jail sentence in 2024 and served the entire term.

The error was finally discovered when lawyer Zeb Brown reviewed the original subpoena while preparing Klayme's appeal. Prosecutors subsequently agreed that the appeal should be allowed.

Klayme explained: "In the latter stages of preparing my appeal arguments, it was discovered that the subpoena contained a subtle mistake that changed the course of my life.

Instead of requesting details for the username 'fus__ro_dah', the subpoena requested details for the username 'fus_ro_dah'. The police officer did not notice that the perpetrator's Kik username 'fus__ro_dah' contains a double underscore. This discrepancy went completely unnoticed at the trial. It was never brought to the attention of the trial judge."

On July 23, the Nova Scotia Court of Appeal overturned the convictions and acquitted Klayme of every charge.

"Mr. Klayme is factually innocent of the offences," the appeal panel wrote. "He should never have been charged, let alone convicted."

The court said the correct username information had been available during the original trial, but there was no evidence explaining how the crucial extra underscore went unnoticed.

It's unclear if Klayme will be seeking compensation for the 18 months he spent in prison.

The whole case stemmed from the user name and nobody noticed they were different? Plus there was no evidence connecting the guy to the crime (because of course not) but convicted anyway? Fucking hell.

Is that different in Canada? How big could his compansation realistically be?

Also were the people involved in that wrongful conviction all a magical DEI hire? How can something like this happen?

You'd think finding zero evidence linking this guy to the crimes and him denying it the whole time, assuming they didn't coerce a confession, would be enough for them to at least think maybe they got something mixed up.

10,000 euros for 18 months?

Looks like he should get 75 euro per day under oldbrate so around 40,000 Euro. Still a damn insult.

You get 75€ per day served in jail. So he would get around 40k € for 18 months here in Germany. They want to raise this compensation to 100 or even 200€ btw.

It is still a joke, but then again you are supposed to sue the people who got you into this mess in the first place and then get a bigger payout that way.

Like there is a very recent case where someone was in jail for murder for over a decade. He got 350k as compensation (the 75€ a day) but then sued the state and got another 750k. Then there was some shenanigans regarding what he cost the jail and that me made 50k in salary during his time which the state wanted to have back. Which prolonged the lawsuit. In the end he got 1.3m €.

The lawyers were still not happy about it, they wanted US conditions, they asked for 1m € per year served.

It's not just 18 months in prison, it's 18 months convicted as a pedo, that's the sort of shit that will follow you around and leave a permanent stain on your reputation even if the courts go "whoopsie, we got it wrong".

I can't imagine he didn't have a lawyer defending him with this. And if he did, how the hell does that lawyer not get this entire case thrown out?

And to make it even worse, newspapers and stations will publish articles about the conviction, but rarely retract when it's proven to be an mistake.

Exactly. You have fucked this guys life up, forever. No telling what he went through in prison, either. Convicted pedos are not exactly popular.
 
Aside from the username mix up, there should have been associated IP addresesses, device IDs and artifacts, profile metadata, timestamped chat records, all sorts of digital forensics to build a legitimate case. Incredibly awful detective work all around. Disgusting incompetence.

The compensation for such a blatant error which could`ve easily cost him everything will and has to be enormous.

18 months in prison will change a man permanently. Whatever money he gets aint worth it. Getting falsely accused like this has to be a fucking nightmare.
 
Forget the username. They found nothing to link him to the CP case and still was sent to jail and found guilty. Wtf. Hello? Reasonable Doubt.

Fucking seriously? This guy should be paid millions for that kind of life-altering abuse. He did 18 months with a pedo label on him. If it was me I'd want to cut the hands off the incompetent fuck that made the original typing error as well.
