The Apple lawyer is going after the fact that Itch.io has porn games on it despite Epic rejecting sexual games on the Epic Games Store

Itch was added to the Epic Games Store shortly before the trial.
Allison says Epic just hosts Itch, not the games themselves. These games are “so offensive we cannot speak about them here"
"There are many games on http://Itch.io, I won’t even read the names out loud, but they are both offensive and sexualized."

Judge is now trying to parse the process of getting from the EGS to “that other store could be downloaded which has all of that offensive material.”
In terms of providing access on mobile, Allison says “I don’t know that we would want to do that with Itch.io."

“Now that you know there are offensive and sexualized app on Itch.io, as the head of EGS, do you plan to do anything about that?”
Allison says he doesn’t know and that these apps are Itch.io’s apps, not EGS's

This can potentially blow up in Epic's face because Epic has established the majority of Fortnite players are kids. Apple can argue Epic laid an easy path to porn accessible to children through Epic's client.

I was looking for good design device, between this and Huawei and Samsung's Tab. Settled on iPad Pro 2020 because of app support and expecting a proper Illustrator on it that turns hand drawings into graphs... Well, that Illustrator native app seems like the new Star Citizen.

Wait, so that's you in the ad?! Is the illustrator app not that good? I thought it was pretty straight from what I've heard, but then again, I've never used it.

Nah I got enough testosterone to not looks so :lollipop_tears_of_joy: . The Illustrator app right now is more like "Illustrator Go". Had to go for Affinity Designer for that reason (my wife). There were a promised, full version of Illustrator that uses AI to draw graphs from hand drawings, which was a major factor of choosing iPad 2020, along with the 120Hz for pen sync (before the new Tab S7+).

AFAIK, still didn't get released yet and you need to do it manually. Affinity Designer seems to be a more complete package so far on iPad Pro, I think.

Isn't all the porn even easier to access using Safari? Wouldn't all Itch.io stuff be behind a payment system that should require users to have credit cards or other payments systems that often expect you to be >18. I feel like that's like saying cable companies or hotels are giving kids easy access to porn because they sell you options to porn.

why make it so difficult to go to find porn to a game platform and ask their parent to buy that porn game?

I don't get it. I imagine there are a million easier paths to porn for those who really want it. If I remember correctly back to when I was a child I don't think I would be that interested in porn anyway. Anyway, don't children have parents these days?

Steam adult games are tagged and age-gated, that's the stipulation for them being on the platform. If you don't have a Steam account, just browsing through the store won't let you see any adult content. Even if you do have an account, you have to specifically enable the adult content categories to see them come up in search, let alone on the frontpage.

I don't remember how Itch.io has it set up, but I sort of doubt it's nearly as thorough.

Mud is slinging left and right. But is anyone really cheering for any of these souless megacorps? Doubt they improve anything except for their shareholders.
 
The article’s headline is completely wrong and frames this incorrectly. That’s not the argument that Apple were making.

The argument that Apple were making was that Epic’s own TOS forbid porn or sexual games, yet they’ve added such games through itch.io, effectively breaking their own TOS. They asked Tim if he’d remove them now that it was pointed out that they break TOS and he said he didn’t know.

Apple’s lawyers’ angle here will to show a contradiction in Epic’s own policy and why they want their platform to be closed; because they can’t even trust third party policies. Showing a company contradicting their own ToS when it selectively suits them to get court brownie points for being an open platform isn’t a good look in court.
