People, you should really use Download later. It's got percentage based progress, is a lot less likely to fail than Download Now in a heavy server load situation like this, and give you an incentive to not stare at the screen waiting for it download since the 3DS needs to be closed to download.

Up to 31% while typing the above sentence.

1. i get to see colorful balls jingle into the smash icon while a little orange bag gets funky
2. satisfying pinging noises of the download occurring let's my ears get ready for hype
3. it's not like you aren't opening your 3ds every 30 seconds (which will actually pause the download)

This is the exact same boat I am in. It is 1:53 AM where I live, and I would really like to get some sleep. I just wanted to start this download before I had to pass out for the night. That is now looking to be highly unlikely.

Same here. I talked both of my friends into purchasing the digital copy. They both get into the eShop immediately and are downloading it. I cannot get in at all. That pisses me off. Seems like it happens to me all the time too.

It's probably not even close, thanks to Japan getting the game a month earlier and them having learned some lessons from the Pokemon fiasco(s). There's absolutely heavy server load, but it seems like it's just blocking people from accessing the shop because of it instead of going overload.
